BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located northwest from 10th Avenue, between East 46th Street and East 47th Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 10 foot wide alleyway beginning on the northwest line of 10th Avenue 140 feet southwest of the intersection of the northwest line of 10th Avenue with the southwest line of East 46th Street, and extending northwest 328 feet between parallel lines, and parallel to East 46th Street, to the southeast line of a 12 foot alleyway abandoned by City of Chattanooga Ordinance No. 10009. Said alleyway separates lots 1-6, block 17, Williams Addition to East End Land Company's Addition No. 4, not recorded, and an unplatted tract, from lots 7-12, block 17, said Williams Addition, and another unplatted tract. Tax Map No. 168I-G-14-23. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
